Florida Law Protects You When Filing a Claim
Many Florida homeowners worry: “Will my premium go up if I file a claim?” The answer is no — not if it’s a valid claim. Florida statutes are designed to protect homeowners from unfair insurance practices.
According to Florida Statute § 627.4133 and related laws:
Your insurance company cannot raise your premium or cancel your policy for filing a valid claim.
Premiums can only be increased based on overall statewide risk factors approved by regulators — not because you used your coverage.
– If rates adjust statewide, they adjust for everyone. So you can either use your benefits… or pay for coverage you never touch.
Homeowners have the right to use their policy benefits when damage occurs without fear of retaliation from their carrier.
In other words: if the damage is real, your claim is valid, and your coverage applies — you are protected by law.
